TERMS OF SERVICE:


  1. At no time are any credit card details stored by us.

  2. All items remain the property of The Evolution until payment has been made in full.

  3. We reserve the right to refuse to sell any goods.

  4. Payment can be made via BACS, Paypal, debit or credit card.

  5. While every care is taken to keep your details secure throughout the transaction process, we cannot be held responsible for any loss you may suffer as a result of an unauthorised third party accessing your details while you place an order.

  6. Under no circumstances can we be held liable or accountable for failed deliveries due to inaccurate address details provided to us by a customer. It is the customer’s responsibility to check details thoroughly, both at time of order and in the Order Confirmation and Despatch Confirmation emails received.

  7. We reserve the right to refuse refunds where it is deemed either by ourselves or by the product manufacturer that product misuse has occurred.

  8. Items claimed as faulty may be returned to us for testing, and in the event that no manufacture defect is present, these items will be returned to you at your cost.

  9. When returning goods to us, please obtain a certificate of postage. We cannot refund or exchange items that fail to reach us. However, with a certificate of postage you should be able to claim compensation from Royal Mail. Where postage costs are to be refunded by The Evolution, only a basic service will be funded. Any services used by a customer which are not basic services (i.e. Special Delivery) may not be refunded in full.

  10. Sale or clearance items are non-returnable.

  11. In the event that a package is sent to you and taken to your local Post Office, it is your responsibility to collect the item before it is returned to us by Royal Mail or by courier. Orders returned to us as uncollected may be re-sent, but you will be responsible for the additional postage fees incurred. If in the circumstances, you would prefer to receive a refund, we will happily refund you, minus the postage fees incurred in the first delivery attempt.

  12. In the event that you place multiple orders to the same address, you remain eligible for any postage charges incurred on orders and we reserve the right to combine packages where appropriate.

  13. In the event that you fail to collect a parcel or provide an incorrect delivery address, you may be eligible for any costs incurred in the parcel being returned to us. This charge will be deducted from any refund given on the original product purchase.

HOW THE CONTRACT IS FORMED BETWEEN YOU AND US


After placing an order, you will receive online notification from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product or Service. All orders are subject to acceptance by us. The contract between us (Contract) will only be formed when you receive the Products and/or Services (as applicable). In the case of Products, the Contract will relate only to those Products which you receive. A contract for any other Products which may have been part of your order will be formed when you receive those other Products.




YOUR STATUS


By placing an order through our site, you warrant that:

- you are legally capable of entering into binding contracts;

- you are at least 16 years old; and

- that you are not resident in a country where making a payment to our site, in line with these terms and conditions would breach any laws in that country.




DELIVERY OF PRODUCTS


In the case of Products, your order will be fulfilled/made ready for receipt (as applicable) within a reasonable time of the date indicated at the time of ordering, unless there are exceptional circumstances.

All orders are delivered via Royal Mail or a courier. We aim to dispatch all goods within 2-3 working days subject to availability.




WARRANTY


We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. All other warranties, conditions or terms relating to fitness for purpose, merchantability, satisfactory quality or condition whether implied by stature or common law are excluded in so far as permitted by law.

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.




CANCELLATION RIGHTS


  1. In the case of Products, if you are contracting as a consumer, you have a statutory right to cancel your Product order for any reason and receive a full refund, except in the case of certain products listed in paragraph 13.
  2. You will receive a full refund of the price paid for the Products (excluding postage costs). Your statutory right to cancel a Contract relating to the purchase of a Product starts from the date when you receive the Product (when the Contract between us is formed). If the Products have been delivered to you, you may cancel at any time within 7 working days, starting from the day after you receive the Products. You will pay the cost of postage when returning any items. We must receive an email notification from you within 7 days of receiving the goods in order to qualify for a refund. In order for us to issue a full refund, goods must be returned unused, undamaged and in original packaging. If an item is returned used or damaged, we will return the item without a refund or exchange. Please email us at contact@theevolution.eu if you would like to return an item.
  3. In the event that you received a Product that is damaged on delivery then please inform us of this in writing as soon as possible. If a Product is returned to us damaged and you have not informed us that the Product was damaged when you received it then we may refuse your right to cancel or receive a refund.
  4. We cannot accept returns of sanitary pads or other sanitary products.
  5. We reserve the right to refuse refunds where it is deemed either by ourselves or by the product manufacturer that product misuse has occurred.

  2. You may only transfer your rights and obligations under your Contract with us if we agree to this in writing.




PRICE


  1. The price of the Products, Services and our delivery charges will be as quoted on our site from time to time, except in cases of obvious error.
  2. Product and Service prices include VAT, where applicable. However, if the rate of VAT changes between the date of your order and the date of delivery, we will adjust the VAT you pay, unless you have already paid for the Products or Services in full before the change in VAT takes effect.
  3. Product and Service prices and delivery charges are liable to change at any time, but changes will not affect orders for Products and/or Services which you then take steps to fulfil/receive within a reasonable time of such order.




REFUNDS


  1. If an order is cancelled in accordance with the paragraphs set out in section Cancellation above, then we will refund the amounts owed as soon as possible following cancellation and in any case within 30 days following cancellation.
  2. If we are due to provide you with a refund then this will be made to the credit or debit card used to carry out the original transaction.
